Ukrayna ve Hollanda/Rusya Kabul Edilebilirlik Kararı Doğrultusunda Avrupa İnsan Hakları Mahkemesi’nin Yetki Yaklaşımına İlişkin Analiz

Öz

Avrupa İnsan Hakları Sözleşmesi’nde yetki, uluslararası hukuktaki karşılığından farklı olarak, taraf devletlerin sözleşmelerden doğan yükümlülükleriyle ilişkilendirilmektedir. Sözleşme’nin ülke dışına uygulanması çerçevesinde devletin yetkisinin tespiti, taraf devletin belirli bir bölge veya birey üzerinde yasama, yürütme veya yargı yetkisi kullanmasından yahut bu yetkilerini kullanmasına ilişkin sınırların belirlenmesinden ziyade; devletin, belirli bir bölge veya hak sahibi birey üzerinde denetim ve otorite uygulaması üzerine kurulmaktadır. Avrupa İnsan Hakları Mahkemesi’nin 2022 tarihli Ukrayna ve Hollanda/Rusya kabul edilebilirlik kararı ise Sözleşme’nin ülke dışına uygulanabilirliği çerçevesinde yetki kavramına, yetki ve atfedilme kavramları arasındaki ilişkiye ve Sözleşme’nin uluslararası nitelikli silahlı çatışmalar sırasında uygulanmasına ilişkin değerlendirme içermesi bakımından önemli bir kararı teşkil etmektedir. Çalışmada ise söz konusu karar çerçevesinde Mahkeme’nin yetki yaklaşımı incelenecektir.

An analysis of the European Court’s Approach to Extraterritorial Application in the light of the European Court’s Admissibility Decision in Ukraine and the Netherlands v. Russia

Öz

In European Convention on Human Rights the concept of jurisdiction is laid down in connection with the obligations arising from the treaties for states, which is different from its international law counterpart. In the Convention system, it is observed that the State is obliged to fulfill its obligations arising from human rights treaties to the extent that it provides authority and control. The bodies of the Convetion use the factual relationship established through two criteria, that the respondent State exercised effective control over an area is beyond its territority or the victims fell under State agent authority and control in territory which is beyond State’s territory, to determine the extraterritorial application of the Convention. In the admissibility decision of Ukraine and Netherlands/Russia by the European Court of Human Rights in 2022, the Court evaluated the concept of extraterritorial application of the ECHR, the relationship between jurisdiction and attribution, and the application of the treaty during international armed conflicts. This study will examine the approach to extraterritorial application within the framework of this decision.
